Hong Kong Media Mogul Jimmy Lai's Landmark National Security Case: What's Next? (2026)

A chilling warning for press freedom in Hong Kong: the sentencing of media mogul Jimmy Lai.

In a city once known for its media independence, Lai's fate hangs in the balance. He's facing a potential life sentence for conspiring to collude with foreign forces and publishing seditious articles. But here's where it gets controversial: the government claims this has nothing to do with a free press, alleging that Lai and others used news reporting as a cover for harmful acts against China and Hong Kong.

Lai's arrest and trial have sparked international concern, with the U.S. and U.K. calling for his release. His daughter, Claire, hopes for her father's freedom, a Roman Catholic who believes their faith rests in God.

Lai founded Apple Daily, a newspaper known for its critical stance against the governments in Hong Kong and Beijing. During his trial, prosecutors accused him of conspiring with former Apple Daily staff and activists to request foreign intervention. Lai argued he never called for sanctions post-law introduction.

The judges ruled Lai was the mastermind, never wavering in his intent to destabilize the Chinese Communist Party. They took issue with his 'constant invitation' to the U.S. to bring down the Chinese government, using Hong Kong as an excuse.

This case sets a worrying precedent, says Urania Chiu, a law lecturer. It broadly construes seditious intent and applies the term 'collusion with foreign forces' to media activities. Chiu warns that offering legitimate state critiques, which often involve international engagement, could now be construed as 'collusion'.

Lai is already serving a nearly six-year jail term for fraud and has been in custody for over five years. His lawyer, Robert Pang, highlighted health issues including heart palpitations, high blood pressure, and diabetes.

The former Apple Daily staffers and activists involved have pleaded guilty, which may reduce their sentences. Some served as prosecution witnesses. The convicted journalists include Cheung Kim-hung, Chan Pui-man, Ryan Law, Lam Man-chung, Fung Wai-kong, and Yeung Ching-kee. Activists Andy Li and Chan Tsz-wah also testified for the prosecution.

Dozens lined up before sunrise to secure courtroom seats, with some arriving on Thursday. Former Apple Daily employee Tammy Cheung hopes for the defendants' release, saying it would be wonderful if they could reunite with their families before the Lunar New Year.

Lai founded Apple Daily in 1995, two years before Hong Kong's return to Chinese rule. The publication gained a strong following with its sensational and investigative reporting, as well as short video reports. Its support for the city's democracy movement, including the 2019 anti-government protests, attracted many pro-democracy readers.

Lai was one of the first prominent figures arrested under the security law in 2020. Within a year, senior Apple Daily journalists were also arrested, leading to police raids, prosecutions, and asset freezes that forced the newspaper's closure in 2021.

Hong Kong's press freedom ranking has plummeted, dropping 68 places to 148th out of 180 territories in the Reporters Without Borders index. The city's latest ranking is 140th, a far cry from its 18th place in 2002.

And this is the part most people miss: the impact of this case extends beyond Lai. It sends a chilling message to journalists and academics, suggesting that legitimate state critiques could be construed as 'collusion'.

What do you think? Is this a fair interpretation of the case? Or is there another perspective to consider? Feel free to share your thoughts in the comments.
